The spout can get in the way once I'm in the tub--I can rotate the spout to the side but not sure if that's ok. hubby says not to do that.

Answer: 
The spout is not designed to swivel. You may want to tighten the set screw or replace it if it has become too loose.

Answer: 
I spoke to American Standard about the valve question and they said if you order the model with the hand shower you do not need to order anything additional to make it work.

After more than 3 hours on hold over 3 call attempts I finally got through to American Standard's so called customer service to confirm that it was defective. Due to their poor telephone support, I'd never purchase from this company again. I recently called one of their competitors for a kitchen faucet warranty problem and got great service. April 7, 2016
