Yes the shelves can be set at every 6 inches or so but they are not able to adjust like every inch or two.
It will protect against rain but it is not moisture proof so the is a chance for some moisture to collect inside it.

As I recall, the legs are not a necessary part for structural integrity and I suppose you could simply not install the legs on the base corners during assembly. The doors will still open and close above the base which is about an inch high. I would opt for a light weight counter top rather than a heavy concrete or stone top and you may have to figure a way to shim the counter level if you are making your Read More

Answer: 
You install the legs when its put together so just do not install them. It will then be about 35 1/2 inches which will still leave room for some stick on rubber pads on the bottom for air flow.
I own this cabinet and it is well made, looks great and not to hard to put together either.

It arrived cracked (not really the manufacturer's fault or a failing of the product, but still disappointing). When it came time to assemble, the various parts fit together very poorly and began to crack during assembly. The materials are cheap and it's quite poorly constructed. Back it went. Avoid. They are out-doors on my deck, and have performed well in the rain, although in very heavy rain some water ended up in the very bottom shelf. I'm going to drill a drainhole in each one to prevent water from collecting again. The units came with all the right parts and hardware, assembled very easily, and I'm very happy with the way they look. The only issue I had was that each one had 2-3 little cracked off corner pieces when I opened each box. Just very minor cosmetic issues that I'll live with. I suspect if the packaging was a little more protective this wouldn't have happened. I live across the border from the US where I purchased these and it's not worth my time returning them. Overall very satisfied, because HD doesn't carry these units in Canada. June 21, 2016

Rated 3.0 out of 5.0 by Inexpensive and built that way The quality of the plastic is poor. The first cabinet that was sent to us was badly broken. The second cabinet had some small broken corners on pieces that were not obvious so we didn't send it back. The design is flawed. Assembly requires you to shave some plastic from the side pieces due to the fact that the mold that creates the back and sides is not properly designed. The plastic is both very thin and very brittle. The shelves are sturdy but the top and inside bottom are flimsy. If I had it to do over I would not purchase. April 26, 2016
