Kerri, It does not seem that the product you are inquiring about is available at this time.
Your stair risers are off then. And if the pitch of the risers is off the railing, you do not want this kit anyway, the ballasters would not be level or plumb to the stairs. If the height works on the level part of the deck, you should fix the stairs to make this work, it would not look right with two different railing heights. And HD does sell the railing wood and ballasters separate from the kit, but you would have to bore your own holes for the railing part, at the correct angle/slope of the stairs. I would recut the stair risers, truly this kit is standard to code and your stairs are not correct.
Measure the distance between posts and, if necessary, cut the 2x4 rails to size by trimming the unnotched end. The balusters and rails have been set to 34 degrees, so if you need to cut the rails and cap rail, cut them to the 34 degree angle.

No, I do not believe it meets the code. The dimensions are too great. Also, the handrail must have a return at each end which these do not. I installed a separate handrail with return on the side. I agree that this is a great product that is easy to install.
