The flapper should be removed somehow as this can cause a blockage if left in your line.
If it is completely submerged with no flow in any direction the flapper will float. The flapper needs some head pressure to either open or close if it is coming back up into the main.

Yes, this product can be used outside below grade. Remember that if the backwater cap is below finished grade, a riser pipe will need to extend upwards off of the backwater cap to the finished grade of the cement or grass. This riser is needed for inspection and cleaning access. The backwater valve must be installed level to allow the internal flapper to operate properly.
